{"id":2789,"date":"2012-10-03T18:52:00","date_gmt":"2012-10-03T22:52:00","guid":{"rendered":"http:\/\/acro.net\/blog\/?p=2789"},"modified":"2012-10-03T18:57:14","modified_gmt":"2012-10-03T22:57:14","slug":"udrp-reform-one-fundamental-change","status":"publish","type":"post","link":"https:\/\/acro.net\/blog\/udrp-reform-one-fundamental-change\/","title":{"rendered":"UDRP reform: One fundamental change"},"content":{"rendered":"<p><a href=\"http:\/\/www.ricksblog.com\/my_weblog\/2012\/10\/bill-hartzer-weighs-in-on-reverse-domain-name-hijacking.html\" target=\"_blank\"><strong>Rick Schwartz points to an article<\/strong><\/a> about reverse domain name hijacking findings, and a much-needed <strong>reform<\/strong> in the <strong>UDRP process.<\/strong><\/p>\n<p>In the past, I&#8217;ve commented at various domain industry blogs and forums, about<strong> one fundamental change<\/strong> that must be incorporated in a potential &#8211; <em>and\u00a0 much-needed<\/em> &#8211; UDRP reform.<\/p>\n<p>The reform *must* include this rule: if X (say, 5) years pass since the registration of a domain and there is no legal motion via a UDRP, any future attempts to challenge the domain beyond that time frame <strong>will be automatically rejected.<\/strong><\/p>\n<p>Five years is an ample amount of time for any potential current trademark holder, to find out their mark is being abused and to challenge that domain. This fundamental change would end such <strong>comical instances<\/strong> when domains such as <a href=\"http:\/\/SaveMe.com\" target=\"_blank\"><strong>SaveMe.com<\/strong><\/a>, registered 14 years ago, are retroactively supposed to be infringing on marks still pending in 2012!<\/p>\n<p>So whoever makes the rules, take notice: this isn&#8217;t 1994 anymore and the UDRP process needs to be updated.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rick Schwartz points to an article about reverse domain name hijacking findings, and a much-needed reform in the UDRP process.
