{"id":51,"date":"2008-08-03T13:30:58","date_gmt":"2008-08-03T18:30:58","guid":{"rendered":"http:\/\/acro.net\/blog\/2008\/08\/03\/aspis-wipo\/"},"modified":"2008-08-03T13:32:11","modified_gmt":"2008-08-03T18:32:11","slug":"aspis-wipo","status":"publish","type":"post","link":"https:\/\/acro.net\/blog\/aspis-wipo\/","title":{"rendered":"The shameful WIPO case of Aspis.com"},"content":{"rendered":"<p>I just came across <strong><a href=\"http:\/\/wipo.int\/amc\/en\/domains\/decisions\/html\/2008\/d2008-0387.html\" onclick=\"pageTracker._trackPageview ('\/outgoing\/http_wipo_int_amc_en_domains_decisions_html_2008_d2008_0387_html');\" target=\"_blank\">this WIPO case<\/a><\/strong> with regards to the domain name <strong><a href=\"http:\/\/aspis.com\/\" target=\"_blank\">Aspis.com<\/a><\/strong><\/p>\n<p>It would have been a typical case, if it weren&#8217;t for the fact that I actually visited the web site back in 1998 when it was registered; its purpose has always been to gripe against the (then) CEO of <strong><a href=\"http:\/\/aspis.gr\/\" onclick=\"pageTracker._trackPageview ('\/outgoing\/http_aspis_gr');\" target=\"_blank\">Aspis Pronoia<\/a><\/strong>, an insurance company in Greece.<\/p>\n<p>Not only does the .com registration predate the complainant&#8217;s Swedish mark by 8 years, it&#8217;s also a generic, dictionary, ancient Greek word that means &#8220;shield&#8221;.<\/p>\n<p>So some Swedish meatball comes to claim a mark that&#8217;s three thousand years old, and only one of the 3 panelists &#8211; Mr. G. Gervaise Davis III &#8211; had the guts to engage full vision, unlike the other two panelists.<\/p>\n<p>Indeed, it&#8217;s alarming to see that the WIPO system is far from flawless and that there is no fair and balanced measure of what constitutes &#8220;legitimate use&#8221;
